CCS Brasil Pathways to scale
Regulation, governance, and enabling conditions for the development of CCS in Brazil.
What is it?
PETRONAS, as a member of CCS Brasil Association, is supporting the development of a Paper on the Regulatory Framework for Carbon Capture and Storage (CCS) in Brazil, developed and to be published by CCS Brasil Association.
The study will assess the current state of the CCS regulatory framework in Brazil and selected international jurisdictions, benchmark Brazil against those jurisdictions, and provide structured analysis of regulatory design options and their trade-offs.
Why this study now?
Achieving deep decarbonization will require a combination of technologies and solutions, reflecting the different characteristics and challenges of each sector. CCS is one of these technologies, with the potential to contribute particularly to the decarbonization of hard-to-abate sectors.
Brazil is now advancing the regulatory framework needed to enable CCS deployment. The Future Fuels Law (Law No. 14,993/2024) established the legal basis for geological CO₂ storage and assigned ANP responsibility for regulating and authorizing CCS activities. The framework has since advanced with Decree No. 13,095/2026, while ANP continues developing detailed implementing regulations.
This evolving regulatory landscape creates an important opportunity for international benchmarking and evidence-based analysis to help inform regulatory decision-making and the assessment of approaches that may be appropriate to the Brazilian context.
Purpose of the study
At a pivotal stage in Brazil's CCS regulatory development, the study aims to provide an evidence-based contribution to the development of the country's regulatory framework.
By bringing together international experience and structured regulatory analysis, the paper seeks to support informed regulatory decision-making and foster constructive dialogue between industry, regulators and policymakers as Brazil's CCS framework continues to evolve.
Rather than prescribing a single regulatory model, the paper will assess alternative regulatory design options, their respective trade-offs and their potential applicability to the Brazilian context.
Study objectives
Establish a clear and current baseline of Brazil's CCS regulatory framework and selected international jurisdictions.
Benchmark Brazil against international regulatory practice, identifying convergences, divergences and remaining gaps.
Identify relevant regulatory design choices and assess alternative options and their trade-offs.

Clear, transparent and predictable regulatory frameworks are important to provide confidence for CCS development and support the conditions for long-term investment. By sponsoring this study, PETRONAS seeks to contribute to an evidence-based and internationally informed discussion on the development of Brazil's CCS regulatory framework.
